1. Acceptance of Terms

By accessing or using RecoveryPulse ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

RecoveryPulse provides website monitoring and automated recovery services for Linux VPS servers. Our service monitors your websites and servers, alerts you to downtime, and can automatically restart failed services when configured.

3. Account Registration

To use the Service, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Be at least 18 years old or have parental consent
• Accept responsibility for all activities under your account

4. Acceptable Use

You agree not to:

• Use the Service to monitor servers you do not own or have authorization to monitor
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the Service for any illegal purpose or in violation of any laws
• Interfere with or disrupt the Service or servers connected to the Service
• Resell or redistribute the Service without our written permission

5. Server Access and Recovery Actions

By providing SSH credentials for auto-recovery features, you grant RecoveryPulse permission to connect to your servers and execute recovery commands (such as restarting services) as configured by you. You are responsible for ensuring the SSH credentials provided have appropriate permissions and that auto-recovery actions are suitable for your server configuration.

6. Service Availability

We strive to maintain high availability but do not guarantee 100% uptime. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify you of planned maintenance.

7. Payment and Billing

For paid plans:

• Fees are billed in advance on a monthly or annual basis
• All fees are non-refundable except as required by law
• We may change pricing with 30 days notice
• Failure to pay may result in service suspension

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RECOVERYPULSE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL DETECT ALL DOWNTIME OR THAT AUTO-RECOVERY ACTIONS WILL ALWAYS SUCCEED. YOU ARE RESPONSIBLE FOR MAINTAINING YOUR OWN BACKUPS AND DISASTER RECOVERY PLANS.

10. Termination

You may cancel your account at any time. We may terminate or suspend your account for violation of these terms or for any reason with reasonable notice. Upon termination, your right to use the Service ceases immediately.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
